This article has been submitted by a victim who went to Court.  It cost them $30,000 in Legal Fees and they were forced to settle prior.

He was advised that if they won, the Finance Company would appeal and it would cost them around $150,000 in Legal Fees, which he could not afford.

From my contribution to this site I hope that I can encourage you to join and contribute to help this ever expanding group of businesses that have been tricked, lied to and grossly misrepresented to,  when signing up their phone deal.

Some of you have written back outraged at these demands, most through a solicitor and generally threatening a legal fight. I am aware in many, many cases where nothing much has happened since the initial demand from the finance company. You may be one of these businesses.  Whilst the matter to you is concerning to have unresolved, no news is better than bad news. Well whilst nothing is happening to you, it is to others. So I believe in these cases no news whilst it lasts means that you should be looking to do something to help yourself and that can be achieved by helping others that are fighting.

Most of us cannot afford the financial crisis that it has or will create. 

 So not doing anything to help anyone could mean that you do not help yourself, and one by one these so called finance companies will win or what is absolutely tragic for everybody still fighting or yet to fight – agree to  a settlement. Hundreds of cases have ended this way. No precedence. The next matter, which might one day be yours, will have you asking “why has this gone on for so long?” and without a result to show in court.   

Fighting these cases in court is beyond the financial reach of most of us as an individual, however, there are a few cases that are being fought by small groups that have banded together. Their progress is slow and at times precarious due to the complexity in linking the phone seller to the financier and having them responsible for the dodgy contracts. In some matters there is an element of hope for some damages.

However, regardless of what anybody says to you to date not a single case has been won in court.

The people involved in the site are looking to keep you up to date information about what’s going on and some financial assistance in a test case in the Federal court. This is most valuable and I’m hoping that it will continue and it can if you will help. There are many things that can be achieved by a group, that will in time serve to help you. If you are not sure ask your solicitor. Please don’t wait for the next demand to do something, just pick up your phone and ask him whether this could be a help to you.
