I was one of a group of 250 that hired a law firm (taking over $400,000 from all of us collectively) to fight the finance company  and 8 mths later it had not seen the inside of a court room even though we were promised a Federal Court application, & it never did.  

We were all advised to settle with the finance company.  

Some of us changed law firms and we have a lawyer and firm who has passion for our cases & since that time, now have a trial date for a test case before the Federal Court.  

Doesn't it make sense to back one case instead of attempting to fight the finance companies in small groups of 3 or 4 only to either lose the case or be advised to settle the matter.  We already have Senior Counsel advice and a lawyer who specialises in Trade Practices Law.  The outcome of this case may have a bearing on all other telco/finance matters even though you may not currently be being pursued by the finance company.

Forte Connect/Truscom/Enterprise Finance Solutions (EFS)

I was offered cheaper phone calls, and as a thank you for signing a 5 year contract, they gave me $4000 worth of “Free” equipment.

My payments were $406/month and my Call Credits were $340/month so the difference of $66/month = $4000 so, even though it was free, I thought I was paying for it anyway.

In the end, the Telephone service stopped and Forte Connect and Truscom closed down.

When I stopped payments, the Finance Company contacted me and told me I still owed another $11,000. I priced the equipment and it was worth $1800 brand new from Domayne.

When I received a copy of the contract from EFS, it had extra equipment added on that I did not receive, ask for, or approve.  After lots of emails to EFS, I finally obtained a copy of the invoice from Truscom (equipment supplier) to EFS. The “Free” equipment valued at $4000 was invoiced for $7500 and the equipment that was added after I signed was invoiced at $11,000.

I had no idea that they had signed me up for $18,500 worth of Finance for $1800 worth of equipment that was supposed to be “Free”. I signed to get cheaper phone calls and the equipment was just an incentive.

In the end, we also found out that Forte Connect overcharged us on our phone calls as well, so even this wasn’t a good deal.

We were contacted by Link Solutions  JOE.RIZKALLAH who said that our phone contract was due to expire, and that we had to sign up for a new contract urgently to avoid a gap in service.

We completed the forms. A few days later the rep. came back with NEW BLANK FORMS , as they had LOST the forms. We were in a meeting when the guy turned up at the office unannounced, to get new signatures from us on blank forms as we had NO TIME to re-do the forms as we would loose our phones if they were not in ‘BY TODAY’.

We did not deal with anyone from a Finance Company, we did not sign for any finance, but we find now that we are up for $150,000.00.

The ‘fix-it’ guy for CLEAR TELECOMS is a guy called LOUIE NASSAR, who came in and tried to smooth things over with us. We have stopped payment of our direct  DEBIT with  QUIKFUND.
